TERMS AND CONDITIONS

These General Terms and Conditions govern the relationship between EUROMAX EOOD (trade name EuroMax), hereinafter referred to as “the Merchant”, and the natural or legal persons who use the website and online store euromax.bg, hereinafter referred to as “the User”.

By accessing the website and/or placing an order, the User declares that they are familiar with these General Terms and Conditions, understand them, and accept them in full.

2. Definitions

For the purposes of these General Terms and Conditions, the following terms have the meanings described:

  • “Merchant” — EUROMAX EOOD, UIC 131127518
  • “User” — any natural or legal person who uses the website or places orders
  • “Website” — euromax.bg, including all subpages and subdomains
  • “Goods” / “Product” — construction material, tool, or accessory offered in the online store
  • “Order” — a purchase application made through the website
  • “Contract” — a distance selling contract between the Merchant and the User


3. Subject

The website euromax.bg provides the opportunity to browse and purchase online construction materials, sound insulation, vibration isolation, waterproofing, paints and varnishes, acoustic solutions, and accessories with its own delivery within the Republic of Bulgaria.

The Merchant is the official representative of REGUPOL for the territory of the Republic of Bulgaria.

For some products (“By inquiry only”), the User sends an inquiry to which the Merchant responds with an individual offer.


4. Registration and Ordering

4.1. No mandatory registration

Orders are placed without mandatory registration of a user profile.

4.2. Order Information

The User is obliged to correctly fill in the following data: – Full name – Delivery address – Email address – Contact phone number – Company details (if the order is issued to a legal entity): name, UIC, VAT No, person in charge, registered address

The User is responsible for the correctness and completeness of the provided data. The Merchant is not responsible for the inability to fulfill an order due to incomplete or inaccurate data.

4.3. Conclusion of Contract

By clicking the “Order” / “Confirm Order” button, the User makes a binding offer to conclude a distance selling contract within the meaning of the Consumer Protection Act.

The contract is considered concluded at the moment the Merchant confirms the acceptance of the order via email or phone call.

The Merchant reserves the right to refuse fulfillment of an order in case of: – Out-of-stock items – Technical errors in the specified price or product description – Inability to contact the User – Suspicion of abuse or fraud


5. Prices and Payment

5.1. Prices

All prices listed on the website are in Bulgarian Lev (BGN) and Euro (EUR), including Value Added Tax (VAT), unless explicitly stated otherwise.

In case of discrepancy between the two currencies, calculations are performed at the fixed rate: 1 EUR = 1.95583 BGN.

Shipping costs are indicated separately before the final confirmation of the order.

5.2. Price Changes

The Merchant has the right to change prices at any time. Changes do not apply to already confirmed orders, except in the cases under Art. 4.3.

5.3. Payment Methods

  • Cash on delivery upon delivery by courier
  • Bank transfer to the Merchant’s account (details are sent with the order confirmation)
  • Online card payment (when the option is activated)

When paying by bank card, the card data is processed by a licensed payment operator and is not stored on the Merchant’s servers.

5.4. Invoicing

Upon request by the User, the Merchant issues an invoice according to the Accountancy Act and the VAT Act. Legal entities must provide their UIC and VAT No when ordering.


6. Delivery

6.1. Delivery Zone

The Merchant delivers within the territory of the Republic of Bulgaria through licensed courier companies.

6.2. Delivery Time

The standard delivery time is between 1 and 5 business days after order confirmation, depending on product availability and the delivery address.

For individual order products (“By inquiry only”), terms are agreed upon individually.

6.3. Shipping Costs

Shipping costs are indicated before the final confirmation of the order and are borne by the User, unless explicitly agreed otherwise.

6.4. Receipt of Goods

Upon receipt, the User is obliged to: – Check the goods for visible damage and discrepancies in the presence of the courier – Sign the waybill only after inspection – In case of established damage — refuse receipt and/or draw up a protocol with the courier

Visible damage established after receipt may lead to a refusal to honor a claim.


7. Right of Withdrawal

7.1. 14-day period

According to Art. 50 of the Consumer Protection Act, the User (natural person) has the right to withdraw from the contract within 14 calendar days of receiving the goods, without giving a reason and without owing compensation or a penalty.

7.2. Exceptions

The right of withdrawal does not apply in the cases under Art. 57 of the CPA, including: – Goods made to individual order or adapted to specific requirements of the User – Unsealed goods unfit for return due to hygiene reasons – Goods whose price depends on fluctuations in the financial market

7.3. Withdrawal Procedure

To exercise your right of withdrawal: 1. Notify the Merchant in writing within the 14-day period at office@euromax.bg with a clear statement of withdrawal 2. You can use the standard form from Appendix No. 6 to Art. 47, para. 1, item 8 of the CPA 3. Return the goods within 14 days after submitting the withdrawal

7.4. Return Conditions

  • The goods must be in original commercial condition — without traces of use, installation, washing, or damage
  • The packaging must be preserved
  • A receipt or invoice must be attached

7.5. Return Costs

Return costs are borne by the User, according to Art. 55, para. 2 of the CPA, unless the goods are defective or do not match the description.

7.6. Refund

The Merchant refunds the paid amount (including initial delivery costs, in case of full return of the order) within 14 days of receiving the returned goods, using the same method as the payment was made, unless the User agrees otherwise.


8. Warranty and Complaints

8.1. Legal Warranty

When selling goods to a natural person, the Merchant is responsible for the conformity of the goods with the contract within 2 (two) years of delivery, according to Art. 112 et seq. of the CPA.

8.2. Manufacturer’s Warranty

When the manufacturer provides a commercial warranty for a specific product, its terms and period are indicated on the product page and in the warranty card.

8.3. Complaints

When submitting a complaint, the User describes: – Nature of the established defect – Date of purchase and delivery – Photos of the defect (if applicable) – Desired method of satisfaction (repair, replacement, price reduction, or termination of the contract)

The Merchant considers each complaint within 14 days of its receipt and notifies the User in writing of the result.


9. Personal Data Protection

Personal data provided during an order, inquiry, or newsletter registration are processed according to our Privacy Policy, Regulation (EU) 2016/679 (GDPR), and the Personal Data Protection Act.

By accepting these General Terms and Conditions, the User agrees to the collection and processing of their personal data for the purposes of fulfilling the contract.


10. Intellectual Property

All texts, images, logos, graphic elements, design, program codes, and other materials on the website euromax.bg are the property of EUROMAX EOOD or are used with proper permission from the right holders (incl. REGUPOL for the respective trademarks).

Copying, reproduction, distribution, or any other form of use without the explicit written consent of the Merchant is prohibited and subject to sanctions under the Copyright and Related Rights Act (CRRA).


11. Limitation of Liability

The Merchant is not liable for:

  • Improper use, installation, or storage of the purchased products by the User
  • Delay or inability to deliver due to the fault of a courier company or due to force majeure circumstances
  • Incorrectly or incompletely entered data by the User
  • Indirect or consequential damages resulting from the use of the products
  • Interruptions of access to the website due to technical maintenance, upgrades, or attacks

Product photos and visualizations are for illustrative purposes. Minor differences in color, texture, or shade compared to the real product are possible and do not constitute non-conformity within the meaning of the CPA.


12. Changes to the General Terms and Conditions

The Merchant has the right to update these General Terms and Conditions at any time. Changes come into effect from the date of their publication on the website.

The current version is always available at euromax.bg/obshti-uslovia/.

The “Effective from” date at the top of the document reflects the current version.

For orders placed before the date of change, the General Terms and Conditions in the version at the time of concluding the contract apply.


13. Applicable Law and Dispute Resolution

13.1. Applicable Law

For all matters not settled by these General Terms and Conditions, the current Bulgarian legislation applies, including:

  • Consumer Protection Act (CPA)
  • Electronic Commerce Act (ECA)
  • Obligations and Contracts Act (OCA)
  • Personal Data Protection Act (PDPA)
  • Regulation (EU) 2016/679 (GDPR)
  • Accountancy Act
  • Value Added Tax Act (VATA)

13.2. Out-of-court Dispute Resolution

In the event of a dispute, the Parties shall make efforts to settle it by mutual agreement.

13.3. Judicial Resolution

In case of inability for out-of-court settlement, disputes shall be resolved by the competent Bulgarian court at the Merchant’s registered office, unless a mandatory legal norm provides otherwise.
